Mandatory Mediation in the Gauteng Division of the High Court

As of 22 April 2025, mediation has become compulsory in civil trials within the Gauteng Divisions of the High Court, following the implementation of the Revised Directive on Mandatory Mediation.

From 1 January 2027, no trial date will be allocated unless accompanied by a formal Mediator’s Report, as required by the Mediation Protocol. This shift reflects the growing emphasis on resolving disputes outside of court, in a more collaborative, time- and cost-effective manner.

Importantly, mediation services must be facilitated by qualified, accredited mediators certified by a Recognised Mediation Organisation (RMO). Our certified mediator, Johan van Zyl, complies fully with these standards

In addition to Rule 41A compliance, attorneys should be aware of the need for:

• Proper Initial and Amplified Rule 41A Notices
• Mediator appointment and Agreement to Mediate
• Submission of a Mediator’s Report at least 30 court days before trial (for 2026 matters)
• Failure to comply may result in trial dates being struck from the roll or cost consequences.
